Terms of Service

1. Acceptance of terms

By downloading, installing, accessing, or using the Wondika application or website (collectively, the “Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

Wondika is designed for children in the early-elementary to upper-elementary grade range, used under the supervision of a parent or legal guardian. By creating an account, you confirm that you are at least 18 years old (or the age of majority in your jurisdiction, if higher) and that you accept these terms on behalf of yourself and any child profiles associated with your account.

2. Description of service

Wondika is an educational application that teaches mathematics to children through AI-generated interactive story adventures. The Service includes:

• AI-generated stories, illustrations, and audio tailored to your child’s chosen math skill and story world
• Interactive math challenges woven into each story episode
• A web-based replay feature for sharing completed episodes
• A parent dashboard for tracking your child’s learning progress

Because content is generated dynamically by artificial intelligence, no two story experiences are identical. While we strive for accuracy and age-appropriateness, AI-generated content may occasionally contain imperfections.

3. Account registration

You must create an account to use Wondika. Accounts are created through Apple or Google authentication. You are responsible for:

• Maintaining the security of your account credentials
• All activity that occurs under your account
• Ensuring that your child uses the Service under appropriate supervision

You may create one or more child profiles under your account. Each child profile stores only the child’s first name and grade level to personalize the learning experience. You confirm that you have the legal right to provide this information about each child.

4. Children’s privacy and parental consent

Wondika complies with the Children’s Online Privacy Protection Act (COPPA), the EU General Data Protection Regulation (including Article 8 on children’s consent), Vietnam’s Decree 13/2023/NĐ-CP on Personal Data Protection, and other applicable children’s privacy laws. Children cannot create accounts; all accounts are created and managed by parents or legal guardians.

Verifiable parental consent. Before any child profile is activated, you must (a) sign in through Apple or Google to authenticate your parent account, (b) confirm in-app that you are the parent or legal guardian of the child, (c) acknowledge our Privacy Policy, and (d) click an activation link we send to your verified parent email address. Together, these steps constitute your verifiable parental consent for our limited collection and use of the child’s first name, grade level, and learning progress as described in the Privacy Policy.

You may review, update, refuse further collection of, or delete your child’s profile at any time through your account settings or by emailing us. For full details, please see our Privacy Policy.

5. In-app purchases

Wondika offers free episodes to get started. Additional episode packs can be purchased through the Apple App Store or Google Play Store. By making a purchase, you agree to the following:

• All purchases are processed by Apple or Google, not directly by Wondika. Their respective terms and refund policies apply.
• Purchased episode packs are linked to your account and do not expire.
• Refund requests should be directed to Apple or Google through their standard refund processes.
• Prices are displayed in your local currency and may vary by region.

Statutory cancellation rights for EU and UK consumers. If you are a consumer resident in the European Union or United Kingdom, you have a statutory right to cancel a purchase of digital content within 14 days of purchase under Directive 2011/83/EU and the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Where you have expressly consented to immediate access to the digital content and acknowledged that you lose this right by doing so, the right of withdrawal does not apply once download or streaming has begun. Where applicable, these statutory rights prevail over any conflicting app-store refund policy and are not affected by these Terms.

6. App Store & Google Play terms

Apple App Store. If you obtained the Wondika application through the Apple App Store, you acknowledge and agree that the following additional terms apply, and that they prevail over any conflicting provision of these Terms:

• These Terms are concluded solely between you and Wondika, and not with Apple, Inc. Apple is not responsible for the Service, its content, or any claims relating to it
• Your licence to use the application is a non-transferable licence to use the application on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions
• Apple has no obligation whatsoever to furnish any maintenance or support services for the application
• In the event of any failure of the application to conform to any applicable warranty, you may notify Apple, and Apple will refund the application’s purchase price to you (if any). To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the application, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be Wondika’s sole responsibility
• Wondika, not Apple, is responsible for addressing any claims relating to the application or your possession and/or use of it, including but not limited to (a) product liability claims, (b) any claim that the application fails to conform to any applicable legal or regulatory requirement, and (c) claims arising under consumer protection, privacy, or similar legislation
• In the event of any third-party claim that the application or your possession and use of it infringes that third party’s intellectual property rights, Wondika, not Apple, will be solely responsible for the investigation, defence, settlement, and discharge of any such intellectual property infringement claim
• You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties
• Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary

Google Play Store. If you obtained the Wondika application through the Google Play Store, the Google Play Terms of Service govern your download and use of the application in addition to these Terms. Wondika, not Google, is responsible for the application and its content.

7. AI-generated content

All stories, illustrations, and audio in Wondika are generated by artificial intelligence. You should be aware that:

• Content is generated dynamically and may vary in quality or accuracy between sessions
• We apply safety filters and content guidelines, but no AI system is perfect — if you encounter inappropriate content, please report it to us immediately
• Math challenges are designed to be educationally appropriate for the selected skill level, but should supplement (not replace) formal education
• Generated content should not be relied upon as a sole educational resource

8. Intellectual property

All content generated through the Service — including stories, illustrations, audio, and the underlying technology — is owned by Wondika or its licensors. You are granted a personal, non-commercial, non-transferable, revocable license to access and enjoy this content through the Service.

You may share episode replays via the web replay feature. You may not reproduce, distribute, modify, or create derivative works from Wondika content for any commercial purpose.

9. Acceptable use

You agree not to:

• Use the Service for any purpose other than personal, non-commercial educational use
• Attempt to reverse-engineer, decompile, or extract source code from the application
• Use automated tools, bots, or scrapers to access the Service
• Share your account credentials with unauthorized users
• Attempt to bypass content safety filters or generate inappropriate content
• Interfere with the operation of the Service or its infrastructure

We reserve the right to suspend or terminate accounts that violate these terms, with or without prior notice.

10. Third-party services

Wondika relies on third-party services to operate, including but not limited to cloud hosting, payment processing, AI content generation, and analytics. These services are governed by their own terms and privacy policies. We select providers that maintain industry-standard security practices, but we are not responsible for the actions of third-party service providers.

11. Service availability

We strive to keep Wondika available at all times, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. Content generation depends on third-party AI services and may occasionally be slower or unavailable.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. If we discontinue the Service entirely, we will provide reasonable notice and honor any unused purchased episode packs where feasible.

12. Limitation of liability

Mandatory consumer rights are preserved. Nothing in these Terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) any breach of the non-excludable statutory rights of consumers; or (d) any other liability that cannot be lawfully excluded or limited under the laws of your country of residence. If you are a consumer, you have legal rights in relation to the Service that cannot be overridden by these Terms, and nothing in these Terms affects those rights.

Subject to the paragraph above, and to the maximum extent permitted by applicable law, Wondika and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. This includes, but is not limited to, damages for loss of data, loss of profits, or interruption of service.

Subject to the first paragraph of this section, our total aggregate liability for any claim arising from or related to the Service shall not exceed the greater of (a) the amount you have paid to Wondika in the twelve (12) months preceding the claim, or (b) one hundred US dollars (US$100).

Subject to the first paragraph of this section, the Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

13. Termination

You may delete your account at any time through the app settings. Upon deletion, your account data and child profiles will be permanently removed in accordance with our Privacy Policy.

We may terminate or suspend your account if you violate these Terms of Service. In the event of termination for cause, you will not be entitled to a refund of any purchased episode packs.

14. Modifications to terms

We may update these Terms of Service from time to time. When we make material changes, we will notify you through the app or via the email address associated with your account. Your continued use of the Service after changes take effect constitutes acceptance of the revised terms.

We encourage you to review these terms periodically. The “Last updated” date at the top of this page indicates when these terms were most recently revised.

15. Governing law

These Terms of Service are governed by and construed in accordance with the laws of the Socialist Republic of Vietnam, without regard to conflict-of-law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of Ho Chi Minh City, Vietnam.

Mandatory consumer protection. If you are a consumer resident in the European Economic Area, the United Kingdom, or another jurisdiction whose consumer protection laws cannot be derogated from by agreement, nothing in this section deprives you of the protection of the mandatory rules of the law of your country of habitual residence (Article 6 of Regulation (EC) No 593/2008 (Rome I) and equivalent provisions). You may also bring proceedings in the courts of your country of habitual residence.

16. Force majeure

Wondika will not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from any cause beyond our reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, pandemic, governmental action, labour disputes, internet or telecommunications failures, failures of third-party AI providers, hosting providers, or app stores, or natural disasters.

17. Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Any attempt to assign without consent is void. We may assign or transfer these Terms, in whole or in part, without restriction, including (without limitation) in connection with a merger, acquisition, reorganisation, or sale of all or substantially all of our assets. These Terms bind and benefit the parties and their permitted successors and assigns.

18. Severability and entire agreement

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

These Terms of Service, together with our Privacy Policy, the applicable Apple App Store or Google Play terms, and any order confirmation or receipt issued in connection with a purchase, constitute the entire agreement between you and Wondika regarding the Service and supersede any prior agreements between you and Wondika on the same subject matter.
